KHALSA FOUNDATION LEARNING HUB
These terms and conditions (together with the documents expressly referred to in them) set out the terms that apply to your use of the Khalsa Foundation Learning Hub (the ‘Learning Hub’). You must accept these Terms before accessing the Learning Hub.
The Learning Hub is a “closed” platform and can only be accessed by members of Khalsa Foundation through registration.
Terms And Conditions
INTRODUCTION
This agreement stipulates the terms and conditions, governed by the law of England and Wales, upon which a place has been offered to your child in the Khalsa Foundation Learning Hub. Once you have accepted a place for your child you are agreeing to be legally bound by these terms and conditions. In this document, guardians will also be encompassed under the term ‘parents’.
We ask that you read the terms and conditions carefully before submitting your enrolment application to us.
- INFORMATION ABOUT US AND HOW TO CONTACT US
You can contact us by emailing us at admin@khalsafoundationuk.onmicrosoft.com. If we have to contact you, we will do so by writing to you at the email address you provided to us when setting up your Account.
- YOUR ACCOUNT
In order to use the Learning Hub, you will need to be granted an account (‘Account’) by Khalsa Foundation. You will be required to provide accurate and complete information. If you have been approved by us for an Account, you will be required to create a password. We recommend the use of a strong and unique password.
You are solely responsible for all activity that occurs on your Account, including any information associated with your Account and anything that happens in relation to it including (without limitation) unauthorised or wilfully malicious access granted by you to another person.
You are responsible for the security of your Account and you must promptly notify Khalsa Foundation, if you suspect that someone has accessed your Account without permission. Your Account is non-transferable and you must not share any credentials or passwords or permit another person to complete any learning on your behalf or access or upload any content on your behalf.
Should you wish to deactivate your Account at any time, please Contact Us at admin@khalsafoundationuk.onmicrosoft.com and we will ensure that your Account is deactivated. This process is normally completed within five working days but may take longer.
We reserve the right to disable or limit the use of your Account at any time without notice and without giving any reason if you have failed to comply with any of the provisions of these Terms or if we suspect any unauthorised use or misuse of your Account, any Content or the Learning Hub generally. Khalsa Foundation reserves all rights not expressly granted by these Terms and conferred by general law. In the event that your Account is disabled, your right to access the Learning Hub shall (without prejudice to any of our rights and remedies) terminate immediately.
- USING THE LEARNING HUB
The Learning Hub is delivered by Khalsa Foundation. It provides a collection of online learning resources and is maintained for your use, contribution and viewing. Access to, usage of and contribution to these resources and facilities is granted in consideration of your acceptance of these Terms.
You agree to use the Learning Hub only for lawful purposes, and in a manner that does not infringe the rights (including, without limitation, intellectual property rights) or restrict or inhibit the use and enjoyment of the Learning Hub by any third party. Such restriction or inhibition includes, without limitation, conduct which is unlawful, or which may harass, or cause distress or inconvenience to any person, the transmission of obscene or offensive content, or disruption of the normal flow of information and dialogue within the Learning Hub.
When using the Learning Hub, you warrant and agree:
i. Not to breach any of these Terms, any applicable law or violate the legal rights (including without limitation intellectual property rights) of any other party;
ii. Not to use any account other than your own or permit or allow your Account to be used by any other person or any similar or comparable act;
iii. Not to upload, transmit or distribute to or through the Learning Hub any computer viruses, malware or any other content of any nature whatsoever designed to cause harm or nuisance to any other computer, property or person;
iv. To follow any reasonable instructions given to you by us in connection with your use of the Learning Hub and to comply with these Terms and all other documents expressly referred to in these Terms; and
When using the Learning Hub you must respect the rights and dignity of others, in order to maintain the ethos and good reputation of the Khalsa Foundation. In particular, you must act in a professional manner with regard to all other users of the Learning Hub at all times.
- DURATION
The agreement will remain in force until the pupil concludes their education with Khalsa Foundation Learning Hub or is either voluntarily withdrawn by parents.
- PROVISION OF EDUCATION
Khalsa Foundation Learning Hub shall endeavour to do all that is reasonable to provide a suitable Gurmat educational environment for every pupil.
- UPLOADED CONTENT
The Learning Hub may contain a variety of content including audio files, videos, text, images, articles, links to third party resources and other materials and third party materials (‘Content’) including Content uploaded by you or through your Account (‘Your Content’). Khalsa Foundation takes no responsibility for and does not review nor expressly or implicitly endorse Your Content. By uploading Your Content to the Learning Hub, you warrant and represent that you have all rights, power and authority necessary or desirable to grant the rights, use and access to Your Content in accordance with these Terms.
When you submit Your Content to the Learning Hub, unless where appropriate you have selected a specific Creative Commons licence type in respect of Your Content or any part of it, you grant Khalsa Foundation a worldwide royalty free perpetual irrevocable non-exclusive transferrable and sublicensable licence to use, modify, adapt, prepare derivative works from, distribute, perform and display Your Content. This licence includes the right for Khalsa Foundation to make Your Content available for broadcast, or publication.
- FEES
Monthly fees are paid by Direct Debit every month and spread over 12 months from January to December. If you have joined Khalsa Foundation Learning Hub throughout the period of the year, your last payment will be in December.
Khalsa Foundation Learning Hub will seek to keep fees stable but reserve the right to increase fees at any time with at least 30 days prior notice. Liability to pay fees and any other additional expenses is the responsibility of the parent or carer.
No refunds will be given if you decide to leave during the period of annual subscription.
- CONFIDENTIALITY
We understand the importance of pupil privacy and it is entrusted that any publication, including photographs, videos and other posts by Khalsa Foundation Learning Hub on our website or on social media will be in the best interests of pupils and require parental consent. By agreeing to our Terms and Conditions, you give consent for your child to appear in recorded lessons if they choose to use the microphone or webcam feature of the virtual classroom. These recorded lessons may be viewed by other pupils of Khalsa Foundation Learning Hub and on social media.
- INTERNET SECURITY
Khalsa Foundation Learning Hub will take all reasonable steps to ensure that your child uses the facilities of the school platform for appropriate purposes, but your child will be held accountable for any misuse. Deliberate misuse will be treated as a breach of Khalsa Foundation Learning Hub rules which will be investigated and may result in the expulsion of a pupil from the Learning Hub.
Pupils will use YouTube and other resources from the internet as part of their lessons. We will never direct anyone to anything that is not educational. It is the parents’ responsibility to ensure that they have appropriate content controls and internet security software to protect their child from inappropriate online content.
- USERNAMES AND PASSWORDS
Pupils shall not share logins with other pupils.
- STUDY ENVIRONMENT
Parents are responsible for ensuring that their child attends lessons. Parents must also ensure that their child has access to the internet and the correct technology to take part in lessons. Refunds will not be given for poor internet connection or if there are issues with the device that the pupil is using.
If a pupil misses a live lesson, they are expected to watch the recording of that lesson at a later date. Khalsa Foundation Learning Hub reserves the right to make changes to the schedule of activities, workshops, lessons and live events.
- BEHAVIOUR
Khalsa Foundation has the authority to deal with all disciplinary matters arising. Parents and pupils accept such authority unconditionally. Khalsa Foundation reserve the right to exclude pupils as a result of the poor behaviour of the pupil.
- DATA PROTECTION
Khalsa Foundation Learning Hub has a policy of recording lessons. This policy is believed to be in the best interest of all pupils and teachers as well as parents. All lesson recordings remain securely on our software provider’s servers. Recordings will only be shown to pupils who were enrolled in a course at the time of a lesson.
- OUR RIGHTS
Khalsa Foundation reserves the right to modify, suspend or discontinue the Learning Hub at any time without notice. You agree that Khalsa Foundation will not be liable to you or to any third party for any modification, suspension or discontinuation of the Learning Hub.
We may amend these Terms from time to time. Every time you wish to use the Learning Hub, please check these Terms (as published on the Learning Hub) to ensure you understand the Terms that apply at that time. Any change will be effective immediately upon the revised Terms being posted on the Learning Hub. You must stop using the Learning Hub and deactivate your Account if you do not agree to such change.
15. PHOTOGRAPHS
You agree to your photographs and videos being taken, which will be used for future Khalsa Foundation promotional materials/events and will be the sole copyright of Khalsa Foundation.
